Clubhouse Waiver and Rules

  I acknowledge that I have read and understand the Rules of clubhouse usage and authorize Karen King & Associates to chargeback any additional costs resulting from my booking. ex. additional cleaning costs/damage to property etc.

• No later than 2 days prior to the Event Date, a non-refundable rental fee shall be collected to cover the cost of electricity, wear and tear, and heat / air conditioning for the event. Rental fees are $75.00 for the Clubhouse and an additional $25.00 for use of the barbeque if required.
• If Lessee wishes to use the Clubhouse for a function other than a social gathering (e.g. sales presentation or other gathering which will net a financial profit), Lessee must submit to the Board a letter setting out the details of the function, stating what products or services will be presented, demonstrated and sold, and what materials will be used. The fee for such functions will be determined by the Board. All other rental terms and conditions contained in this Agreement will apply.
• If Lessee wishes to use the Clubhouse for a function which is of benefit to other Waters Edge Residents (Club members), such as a lecture, CPR or first aid training classes, discussion groups, dance or yoga classes, etc..., the Lessee must submit to the Board for approval a letter explaining the purpose of the meeting or gathering, what will transpire, who the speaker(s) or trainer(s) will be, and expected attendance figures. These activities must be open to all Waters Edge Resident (Club members). All other rental terms and conditions contained in this Agreement will apply.
• Unless previously agreed to in writing, decorating of the Clubhouse shall take place on the Event Date. No nails, tacks or staples are to be used on walls, ceilings, doors or other surfaces. Decorations must be made of fireproof materials.
• Security code must be entered and locked upon the function ending. Condo By laws and quiet enjoyment is 11:00 pm.
• The Clubhouse shall be left in “broom clean” condition. Cleaning shall be the responsibility of the Lessee and shall include, but not be limited to, vacuuming, appliances wiped down, removal of all food and drink brought in for the function, removal of all decorations put up for the function, general clean up and collecting and removing garbage from the Clubhouse premises and grounds, including the kitchen, rental room, entrance area, bathrooms and furniture. All garbage must be bagged and closed and put in the trash bins as instructed by the On-Site Property Manager. Cleaning supplies and equipment (including vacuum, mops, buckets, brooms and dustpans) shall be provided by the Condo Corporation. Lessee is responsible for the return of all cleaning equipment.
• Upon closing up the Clubhouse, Lessee is responsible for ensuring that the heat is set at 18 degrees Celsius, the fireplace is turned off, appliances are shut off, lights are turned out, and all doors and windows are properly closed and locked.
• The Clubhouse is to be returned to the same clean slate and set up with all items used and cleaned and restored by 10:00 am the next morning. Please note that if the Clubhouse is left excessively dirty the On-Site Property Manager will contact the Lessee to attend to a walk through after the event. The deposit that is for cleaning could be cashed if clean- up is not completed properly.
• Changes to the reservation must be made at least 2 days prior to the Event Date.
• Prior to the commencement of the event, Lessee and the On-Site Property Manager shall inspect the rental area and make note of any damage found. Both Lessee and the On-Site Property Manager must sign the inspection report. On the first business day immediately following the Event Date, Lessee and the On-Site Property Manager shall re-inspect the rental area and note any additional damage which was not recorded on the initial inspection report. Any such additional damage shall be deemed to have been caused by the use of the Clubhouse for the event, and shall be the responsibility of Lessee.
• Condo Corporation # 072 6974, its Board, managers, employees, agents, insurers and representatives will not be responsible for and shall have no liability for loss, damage or injury that may occur to persons or property of Lessee, Lessee’s guests and invitees. By executing this Agreement, Lessee hereby indemnifies, saves harmless and releases Condo Corporation # 072 6974, its Board, managers, employees, agents, insurers and representatives from any and all claims for any such loss, damage or injury. This specifically includes, but is not limited to, any liability resulting from the service of alcoholic beverages.
• Lessee is responsible for ensuring that all attendees of the function park only in the Clubhouse parking area(s) or other Visitor designated parking areas.
• Lessee is at liberty to invite non-members to the function as guests, however, Lessee shall be responsible for ensuring that all guests conduct themselves in a proper fashion and in a manner that will not disturb the use of other Club facilities and common areas by other members and their guests.
• Lessee will not use the Clubhouse for any purpose or activity prohibited by law.
• Lessee will comply with any and all federal and provincial statutes, regulations and ordinances including but not limited to requirements relating to the service of alcoholic beverages and fire safety. The maximum number of persons permitted in the Clubhouse is 90 people. Pets, unless for medical reasons, are not permitted in the Clubhouse.
• If the Clubhouse is to be used for a juvenile function, the Provincial Guidelines will apply for adult supervision.
• All functions are subject to the approval of the Board, which reserves the right to terminate any rental which, in the sole judgment of the Board, is inappropriate or may result in unlawful conduct or activities which violate the rules and regulations of the Condo Corporation # 072 6974.
